Rob, if you actually had evidence of financial fraud I’m sure you would have brought it to a court of law by now.

Why did Madoff get away with his fraudulent fund for so long, Sensible?

Do you think it was hard to see that it was fraudulent? It wasn’t. There was a CPA who did the numbers and showed with 100 percent certainty that the Madoff fund was fraudulent. He wrote to the SEC and told them. They did nothing.

Then the fund collapsed. People lost most of their retirement money. THEN the authorities acted.

I am 100 percent in favor of having this matter addressed in a court of law TODAY. That’s better for every single person involved. Doing it today would mean your prison sentence would not be as long. Doing it today would mean that all the Wall Street Con Men could move on to doing productive work again. Doing it today would mean that we could bring this economic crisis to an end and enter the greatest period of economic growth in our history. Doing it today would mean that I could get my $500 million settlement check in hand and take over ownership of the Bogleheads Forum and all that good stuff. It’s a win/win/win/win/win.

Guess what?

IT IS NOT UP TO ME.

I can say that I think it would be better to do it today. And I do. But I cannot make it happen by myself. We need to get lawyers involved. We need to get prosecutors involved. We need to get journalists involved. And on and on.

For that to happen, people need to feel safe about posting honestly.

Wade Pfau almost made it happen. Wade and I together could have gotten this 12-year saga written up on the front page of the New York Times. That would have been the end of Buy-and-Hold. The entire Get Rich Quick house of cards would have come tumbling to the ground in six months.

But it turns out that Wade is one of those darn humans! He is responsible for two small children. He didn’t take to the idea of losing his job. He noticed how brutally abusive you Goons are and how unwilling Bogle is to get involved and he took a pass on seeing his career destroyed for the “crime” of co-authoring the most important piece of peer-reviewed research published in the last 3o years.

I am 100 percent in favor of going to court TODAY, Sensible. It’s not my call.

That’s not how Get Rich Quick schemes work. Get Rich Quick schemes are POPULAR until they bust. That’s what pulls people like you in! You are in the process of losing most of your money. But it does not make you happy to lose most of your money. You are lying to yourself. You are deceiving yourself.

You will be mad like everyone else when the bubble bursts. Perhaps you will demand your own imprisonment! That would be a Twilight Zone twist, would it not?

I wish that I could spare you the pain. I wish that I could spare Bogle the pain. I wish that I could spare millions of middle-class investors the pain.

But I am not superman, my old friend. I am some guy whose only claim to expertise in this field is that I figured out how to get my words posted to the internet.

I am going to bring the thing to court on the day it becomes possible for me to do so successfully. I am not going to lollygag. I am going to act with great dispatch. But I need freakin’ lawyers who will take the case on a contingency basis to proceed with the civil suits. And I need freakin’ prosecutors to proceed with the criminal actions.

I get your point. The cases should have been brought YEARS ago. I am 100 percent with you re the core point. I contacted lawyers in September of freakin’ 2002!

But it is not my call.

The Buy-and-Hold Crisis hurts everyone alive on the planet today. We all need to pull together. This is not a one-man job. I didn’t see that in September of 2002. I sure as heck see it today.

I will do my part to get this thing going as soon as humanly possible. You have my pledge.

But there are limits to what I can pull off. This is bigger than just me.

I will continue to seek people willing to help out. But I cannot do this alone. It is just too big.

So you are going to need to be a bit patient, whether you like the idea or not and whether that makes sense to you or not. It’s one of those darn realities that we all just have to accept.

Actually what X said does make perfect sense. It is actual mathematical proof that you have made zero progress and your time, even by your own accounts, is absolutely worthless.

So all efforts to achieve civil rights were of zero value except for President Johnson’s signing of the Civil Rights Act?

I don’t buy it, Anonymous.

You never get to the point where a President is signing a Civil Rights Act unless people in earlier days work up the courage to object to racism.

These things have to be done in a certain order.

If men were angels, Jack Bogle would have given a speech back in 1981 noting that Shiller’s research shows that there is precisely zero chance that a Buy-and-Hold strategy could ever work for a single investor. Then the Trinity study would never have been published. Then Greaney would never have gotten the numbers wrong in his retirement study. Then he would never have experienced embarrassment when I pointed out his errors. Then there never would have been any death threats. And on and on.

Men are not angels. Bogle went into cover-up mode when the flaws in his strategy were pointed out to him. These things happen. They happened here.

We don’t get to perfection in a single step.

People need to lay the groundwork.

I have laid a lot of groundwork at this site.

People are afraid that the Wall Street Con Men will destroy their careers if they post honestly. It’s a lot harder for the Wall Street Con men to do that now that I have documented the 12-year cover-up of the errors in the Old School SWR studies at this site.

If the Wall Street Con Men try to bring a lawsuit against someone for posting honestly, that person can use the material at this site to protect themselves. The Wall Street Con Men very much do not want the material at this site being publicized. So they are less likely today to bring such a lawsuit.

That helps us. The less likely the Con Men are to bring a lawsuit, the more likely people are to post honestly.

There will come a day when people will look back and say: “Of course Buy-and-Hold can never work. That’s so obvious. How is it that there was ever any controversy on this point?”

There was once controversy because the Buy-and-Holders once possessed great power and were able to use it to punish those who tried to post honestly. Every day that power gets weakened a little bit more because of the efforts of the thousands of us who have posted honestly at some point over the course of the past 12 years.

I have made amazing progress, more progress than I could possibly have imagined it was possible for any one person to make in the course of only 12 years. All signs are that I will be making a whole big bunch more progress following the next price crash.

You need to be physically in a prison cell to feel that any progress has been made.

So be it. I cannot change you.

When you are placed in your prison cell, you will see how we have been making progress for many years now, little by little, bit by bit.

I certainly wish you all the best that this life has to offer a person.

If people REALLY saw value, they would pay you. I think you have been paid what you are worth. By the way, there are no charges, thus no felonies. Only your imagination. Your lack of success is of your own shortfalls. Stop trying to blame someone else for your problems.

I have had hundreds of people tell me that they perceive HUGE value in my work, Anonymous. The value of the work is not in question.

We obviously need to see enforcement of the law for me to collect what is owed me.

Financial fraud is a crime,a felony.

When your prison sentence is announced, I am going to have zero trouble collecting the $500 million. When your prison sentence is announced, we will be seeing honest posting at every board and blog on the internet and Buy-and-Hold will within six months be perceived as an obscene phrase.

I earned the money and I intend to collect it.

I encourage lots of others to follow my lead. The investing field is a money field. There are BILLIONS of dollars to be made in creating honest calculators and in writing honest books and article and in giving honest speeches and all the rest. The people who will make the most are the people who get in early.

People are afraid of the Wall Street Con Men and of their Internet Goon Squads. The reality is that both are paper tigers. There is nothing that the Con Men or their Goon Squads can do to us given the materials housed at my site. They don’t want the millions of middle-class investors whose lives they have destroyed finding out how they have been lied to. So they very much don’t want to do anything to bring publicity to this site.

I am happy to help out anyone who is attacked by the Con Men or by their Goon Squads by pointing people to the materials at this site. So the dangers that people perceive are no longer real.

The intimidation tactics continue today. But I believe that people will work up the courage to stand up to you Goons following the next price crash. I sure hope they do!

Anyway, we will see what happens then.

He says “timing” and that is what it means long term timing is still timing. It means ALL timing. Tell me where he says timing excludes long term timing. So, do we have an agreement? Are you ready to accept the consequences.

You are right that long-term timing is a form of timing, Anonymous.

That is why it is a Big Lie for the Buy-and-Holders to say that there is research showing that timing doesn’t work. Timing ALWAYS works. There is 33 years of peer-reviewed research showing that.

Short-term timing doesn’t work. If the Buy-and-Holders said “short-term timing doesn’t work,” that would be honest. Given that long-term timing always works and is always 100 percent required, the claim that “timing doesn’t work” is a Big Lie.

I don’t believe that it was a lie in 1965, when people first started saying it. It was then a mistake. Fama never checked whether long-term timing worked or was required. He only looked at one form of timing (short-term timing) and jumped to a hasty conclusion that what was true of one form of timing was true for the other form of timing. Shiller was the first to test long-term timing and he found that Fama was wrong to jump to his hasty conclusion. Every test of the question done in the 33 years since shows the same thing.

A mistake that has been covered up for 33 years is a Big Lie. It is my job to EXPOSE the Big Lie. I want millions of middle-class investors to know what was done to them. I want to see those who have engaged in financial fraud to cover up the Big Lie sent to prison.

Why? Because the announcement of your prison sentence is going to go viral on the internet. Once it is common knowledge that the claim that a Buy-and-Hold strategy (failing to exercise price discipline) might on some distant planet work out well for one or two long-term investors is a Big Lie, we will all be able to pull together and work to bury the smelly Buy-and-Hold garbage 30 feet in the ground, where it can do no further harm to humans and other living things.

Valuation-Informed Indexing is Buy-and-Hold with the dishonest Get Rich Quick element removed. Good for Valuation-Informed Indexing! I advocate Valuation-Informed Indexing, the first TRUE research-based strategy, a corrected form of Buy-and-Hold that actually works in the real world.

Does all of that not make good sense?

If I give you a link that backs up Shiller saying not to use CAPE to time the market, will you agree to apologize and admit you were wrong and also admit you are wrong on buy-hold-rebalance? I would also expect you to apologize to those you have called goons on this issue.

I am willing to back up my comment or do you want to just apologize now.

The statement would have to be “don’t use CAPE to engage in long-term timing” for me to do any of those things.

Fama showed in 1965 that short-term timing doesn’t work. The same 140 years of historical return data that shows that all investors who want to have a realistic chance of long-term investing success MUST, MUST, MUST practice long-term timing (price discipline) also shows that short-term timing doesn’t work.

The Big Buy-and-Hold Lie is the suggestion that the finding that short-term timing doesn’t work somehow suggests that long-term timing (price discipline) either might not work in some circumstances or might not be 100 percent required in some circumstances. I am not trying to cover up that lie. I am trying to EXPOSE that lie. I want hundreds of millions of middle-class people to know how their financial futures and our economy have been destroyed by the reckless and relentless and ruthless promotion of that lie by the Wall Street Con Men and their Internet Goon Squads.

It is my thought that we should permit ethical people to work in this field. I see it as a win/win/win/win/win.

All I can say is the moderators of Bogleheads are slightly demented in their views. As noted by the author they allow personal to vile attacks against those who question orthodoxy and will not allow even the slightest retaliation. I was victimized by one of the many pets of the moderators and banned because I privately chided the moderator for selectively editing my posts and while allowing her pet’s direct personal attacks to remain. That got me permanently banned.

There is a lot of useful information in that forum. However understand that there is an almost religious fervor that courses through that forum. It really is disturbing.

You stated things well, Izod.

I like it that you said: “There is a lot of useful information in that forum.” That is true. And it is important to point that out. Complaints about the Bogleheads Forum often leave the impression that it is the entire community that is lacking. No! The majority of community members at the site are wonderful; they are smart and good and generous people. The entire community should not be blamed for the actions of a few. There were a number of surveys taken during the time I posted there and a number of posters famous for posting honestly on the peer-reviewed research in this field were shown to be among the most popular posters at the site. I was Public Enemy #1 to the “leaders” of the site from the first day I posted there but there were many community members who directed very kind words to me in gratitude for my efforts to turn things around.

Yes, the moderators are demented. To suggest that they are only “slightly demented” is to be exceedingly charitable. You are to be applauded for your kindness but people listening in need to know the full realities. The moderators at the Bogleheads Forum are not slightly demented, they are 100 percent demented. There was a poster there who summed things up well with the statement that: “There are a bunch of trolls running around calling everyone else trolls!”

People who care about stock investing should want to figure out what is causing this problem. It is an exceedingly odd phenomenon. The strategy promoted at the board is Buy-and-Hold. Buy-and-Hold is marketed as a research-based strategy. The benefit of following a research-based strategy is that doing so helps investors avoid making emotional decisions. For those following research-based strategies, investing is pretty much a mathematical puzzle. Math is not known as an emotional subject. So what the heck is going on here?

I never went to investing school and I never managed a big fund. But I am the world’s leading expert on this one! I am the person who discovered the errors in the Old School safe-withdrawal-rate studies. I reported what I knew on the morning of May 13, 2002. The reaction of a guy (John Greaney) who had prepared one of the Old School studies was to threaten to kill my wife and children if I continued to “cross” him by posting honestly on SWRs. 200 of my fellow community members (most of these people had become friends with me over the course of my three years of posting at the board) endorsed this guy’s death threats. They didn’t say that I was wrong and publications like The Wall Street Journal have confirmed in the days since that I was right. They just couldn’t bear to hear me report accurately and honestly what the historical data tells us about SWRs.

Huh?

People are following a research-based strategy and they don’t want to know what the last 33 years (it was only 21 years at that time) of research says? That doesn’t make sense.

It doesn’t make LOGICAL sense. It DOES make EMOTIONAL sense.

The mistake that the Buy-and-Holders made was to ignore valuations. Both overvaluation and undervaluation are caused by investor emotion (the rational thing would be for investors to set stock prices properly). The research of the past 33 years shows that investor emotion is about 80 percent of the story. Get that one right and you cannot lose in the long term. Get that one wrong and you cannot win in the long term.

The Buy-and-Holders got that one wrong. So they cannot win in the long term (according to the last 33 years of research). How do you think that makes them feel?

IT MAKES THEM FEEL AWFUL.

That’s why you see what you see at that board, Izod. The Buy-and-Holders are HURTING.

The best thing for them to do would be to acknowledge their mistake. But the bigger a mistake it is that is made, the harder it is to acknowledge. The Buy-and-Hold Mistake is the biggest mistake ever made in the history of personal finance. There are now millions of middle-class people who are in the process of experiencing failed retirements because of this mistake. The Buy-and-Hold Mistake was the primary cause of the economic crisis, which caused millions to lose their jobs. The Buy-and-Holders have hurt their friends and neighbors and co-workers and fellow community members in very serious ways. They are feeling a burning shame over their mistake. How would you feel in those circumstances?

What makes things worse is that most of us who are aware of the mistake are afraid to speak out about it. Robert Shiller knows. He tells some of what he knows but he keeps a lot of what he knows buttoned up because he knows how much it upsets the Buy-and-Holders for anyone to tell the plain, honest truth about what the last 33 years of peer-reviewed research teaches us about how stock investing works in the real world. It’s the same with Bill Berntein. It’s the same with Larry Swedroe. It’s the same with Scott Burns. It’s the same with Todd Tresidder. It’s the same with Wade Pfau. Its the same with Jack Bogle. It’s the same with Mike Piper. And on and on and on and on and on.

The mistake is so big that hardly anyone dares to point it out and demand that it be corrected. You have heard of companies that are too big to fail? The mistake made by the Buy-and-Holders is The Mistake Too Big to Correct.

So the suffering continues.

The millions of middle-class investors being tricked by the Buy-and-Holders suffer. And the Buy-and-Holders themselves suffer. And of course all the people who work in this field and who would like to be doing productive and meaningful and honest and important work suffer. Bloggers suffer. Academic researchers suffer. Journalists suffer. Economists suffer. Investment advisors suffer. It’s too, too sad.

Thanks for asking an intelligent question, Z.

You are right that the money is real for practical purposes in the short term.

This is an important fact. This is probably the single most important reason why so many smart and good people are taken in by Buy-and-Hold. It creates temporary wealth that is treated as real by banks and airlines and other institutions.

It never lasts. We have 33 years of peer-reviewed research based on 140 years of historical return data showing that. It’s not real.

I am telling you what the peer-reviewed research shows us. If you don’t want to believe it, you are of course free to believe whatever you prefer to believe. I am not free to lie about this matter. It would be fraud for me to do so. I am going to continue posting honestly. I don’t dare to consider the possibility of playing it any other way.

Yale Economic Professor Robert Shiller was awarded a Nobel Prize for his work in this area. You don’t receive a Nobel Prize for repeating the conventional wisdom. Shiller taught us something very important and very new. Shiller’s work has far-reaching implications. All of my work explores those implications.

There are thousands of economists who would like to be exploring these implications and writing about what they come up with on a daily basis. They do not feel free to do so because the Buy-and-Holders will destroy their careers if they do so. This is going to have to change. We are headed to a dark place if we do not make this change soon.

I believe that we will make the change following the next price crash. Once we do that, the problem will go away. Once investors know what the research says, most will be happy to take into consideration the findings of the past 33 years. Once most investors are taking those findings into consideration, there will never again be insane overvaluation. It’s just not something that we will ever again need to worry about. It’s crazy to have the amount of your accumulated life savings jumping all around. We all should be happy that the days in which we need to endure such nonsense are in the process of coming to an end.

The fact that as a society we have not been able to accept what the research says or even permit open discussion of what the research says does not suggest that these findings are unimportant. The reality is entirely to the contrary. It shows that we understand on some level of consciousness that these findings are of HUGE importance. It is because they are so important that they are so disconcerting to the millions of people who built their retirement plans pursuant to the very different findings of preceding years.

The people who owned stocks in early 1929 were able to buy things that they were not able to afford in late 1929 because of one of our earlier experiences with the wonders of Buy-and-Hold strategies. The banks and airlines accepted those portfolio values at face value for a time. But then, when the Pretend Money disappeared, the value assigned those portfolios changed in a dramatic way. That’s the way it works. That’s what we have up ahead of us again when we experience the next price crash.

Stock crashes are a horrible, horrible thing. We all should want them to be brought to an end. Shiller showed us how to do that. To bring stock crashes and the economic crises that inevitably follow them to an end, we need to stop encouraging people to believe in the Pretend Money. We need to do just the opposite. We need to DISCOURAGE belief in the Pretend Money. We don’t want to ban honest posting re the past 33 years of peer-reviewd research, we want to ENCOURAGE honest posting about the past 33 years of peer-reviewed research. It is by being exposed to honest posting re the peer-reviewed research that we all advance in our understanding of how stock investing works.

We are the luckiest generation of investors ever to walk Planet Earth. Why? Because we are the first generation to have the last 33 years of peer-reviwed research, the research that puts the final puzzle piece into place, available to us. I think we should be taking advantage of our good fortune rather than pissing it away.

It makes you happy to have banks and airlines recognize Pretend Money. Why? How does it help you to have that money credited to you ONLY FOR A SHORT TIME. It is my belief that that hurts you. If you knew the true value of your portfolio, you could plan your financial future far more effectively. I see no benefit to being tricked. Which is what is happening if you come for a time to believe that Pretend Money is real. If short-term timing worked, you could cash out just at the right moment. But it doesn’t. So how does this fantasy belief help you?

What do you think it means to say “valuations affect long-term returns” if it does not mean that a portion of investors’ current portfolio value is Pretend Money? My feeble brain is not able to come up with any other way to interpret the statement. If your far superior Goon brain is able to come up with something, I would sure like to hear about it.

We once thought that stock returns were random. That’s why they named the famous book “A Random Walk Down Wall Street.” Then Shiller showed that valuations affect long-term returns. That means that long-term return are NOT random. Shiller’s research changed our fundamental beliefs about how stock investing works in a “revolutionary” (his word) way. We all need to recognize that and to begin reaping the benefits that follow.

That’s my sincere take re these terribly important matters, in any event.

Maybe a better question is this: Which specific financial experts will NOT be going to prison in your opinion?

There’s a concept that is referred to in the law books as “industry practice” or “industry standard” or something like that. The idea is that one indicator of fraud is engaging in behavior outside the norm of the field in which you work.

That concept won’t do the job in the investing advice field. The entire industry is corrupt. We have known for 33 years that there is zero chance that a Buy-and-Hold strategy can ever work for even a single long-term investor. But people in the field noticed that the pure Get Rich Quick approach brings in the bucks just fine, peer-reviewed research be danged.

The standard here has to be broader. We certainly don’t permit 12-year cover-ups of errors in studies that people use for an important purpose in any other field. And we obviously adopted the laws against financial fraud for a reason. If we are going to send Bernie Madoff to prison, it’s more than a little hard to justify not doing the same for the sorts of individuals who have put forward posts in “defense” of Mel Linduaer and John Greaney, who obviously have caused 500 times the human misery.

We can’t send everyone in the field to prison. It’s not practical.

But I think it’s fair to say that the millions of people whose lives have been destroyed are not going to be in a terribly forgiving mood when they learn about the 12-year cover-up. So we are going to need to see action that insures beyond any doubt whatsoever that a message will be sent strong enough to insure that nothing like this will ever happen again.

My guess is that, soon after the next price crash, a number of people will come forward. They will say that their consciences just will not permit them to keep quiet any longer. Then there will be a deluge of truth-telling. . Lots of people will be hoping that by coming forward early, they will either be able to avoid prison or limit their sentences significantly. And It Will Be Clear That the Buy-and-Hold Mafia Just Does Not Have the Power to Maintain the Cover-Up Any Longer.

We will see a media frenzy. That will lead to congressional hearings.

My guess is that there will be responsible people who will come forward with the aim of bringing the nasty side of things to a quick end so that we can all get about the business of taking advantage of the wonderful research findings that the Buy-and-Hold Mafia has been denying us for 33 years now. It wouldn’t surprise me if Congress adopted some form of amnesty for advisors who recommended Buy-and-Hold strategies but who did not show any evidence of bad intent.

I believe that the prison sentences will largely be limited to those who advanced threats of physical violence or who made demands for unjustified board bannings or who advanced hundreds of acts of defamation or who participated in or covered up threats of physical violence against academic researchers. I don’t think that we will be hearing any objections to long prison sentences for those sorts of individuals. It might be that there are other sorts of insanely abusive behavior that has been going on behind the scenes and that that will come out when people are coming forward with honest accounts in an effort to save their skins. But it would be the same general sort of behavior we would be talking about. People don’t care about people making mistakes. People get angry when people are dishonest and when they engage in a cover-up. It’s the people who have engaged in clear acts of dishonesty or cover-ups who should be most concerned about their futures, in my assessment. That means you, Anonymous!

Once the first prison sentences are announced, I believe that all the ugly stuff will come to a quick end. We will see a total reversal. We live in the most exciting time to be an investor in the history of the planet. There are billions of dollars to be made providing millions of middle-class investors with tools that are consistent with what we have learned from the peer-reviewed research over the past three decades. Once there is an announcement of ANY prison sentences, we will be seeing good stuff piled on top of good stuff piled on top of good stuff.

It may take decades for all the criminal and civil cases to work their way through the system. Does it really matter all that much? The good stuff here is 50 times more good than the bad stuff is bad. I think that will be the focus for all except those personally involved in the criminal and civil cases. I obviously cannot say how each case will be resolved. It is going to depend on the behavior of the individuals involved. There will be testimony taken at trials. That’s how the system works, no?

I ain’t going to prison! I know that much! There is no one else alive who has done as much to rein in you Goons as I have. There is no one in a close second place.
